PROVO, Utah – The family of Charlie Kirk faced his first-degree murder co-accused in a Utah court Monday – the first day of what is expected to be a week-long trial.
Tyler Robinson, 23, was already in the room before the media was allowed in around 8:55 a.m. He was wearing a gray suit, pink shirt and black tie, with his wrists and ankles bound. Later in the trial, when video footage of Kirk’s shooting was played for the parties and the jury, it showed no visible reaction when the fatal shot rang out.
Utah State Bureau of Investigation Agent David Hull was on the stand to present several videos, including footage of Kirk’s death that was not shown publicly in court but was shown to the judge and attorneys for both sides. Two of them were described as showing them when the gunshot hit Kirk in the neck, including the sound the reporters heard.

While Judge Tony Graf Jr. moved and leaned against the screen when a gunshot rang out in one of the videos, Robinson didn’t move in either.
Kirk’s family had already left the court before the game. They were expected to receive warnings before clear evidence was presented and they were left twice before the actual killing was mentioned.

During most of the trial, Erika Kirk and her in-laws, Rob and Kathy Kirk, sat next to each other, watching the proceedings, occasionally looking at each other or looking down. Other relatives in attendance included Erika’s sister, Tonya, and a niece and nephew.

While Kirk’s family was out of court, Hull also testified about the autopsy report, which ruled Kirk’s death a homicide of a gunshot wound to the neck. During that testimony, Robinson’s mother leaned over her husband and put her hand on his shoulder.
The Kirks have also had high-profile supporters join them in the past — including Donald Trump Jr., his wife Bettina, and conservative commentators Jack Posobiec and Brandon Tatum.

The first witness of the day was Officer Christopher Bagley, now a member of the Spanish Fork Police Department. He was working at Utah Valley University when Kirk was shot and killed at the Turning Point USA event there on September 10, 2025.
He testified that he believed he heard a gunshot – not a gun – coming from the Losee Centre. He said he came to that conclusion after seeing an empty gun on the ground in the early chaos and looking up to see that the roof of the Losee Center had a clear line where Kirk was speaking.

He went to the roof of the Losee, where he found a black and red screwdriver and what he described as a “sniper’s pad.”
He also said that he analyzed the surveillance video of the suspect on the roof, found traces on the grass where the suspect fell and put scuff marks on the roof above them. Defense attorney Kathy Nester only got 10 minutes of cross-examination before the lunch break, but she asked Bagley what direction his police report from the day said the gunfire came from.

It didn’t happen, he said. He also didn’t know what was going on with the gun.
As prosecutors planned to show some UVU surveillance video, Robinson’s defense objected. Although Graf withdrew most of their objections throughout the day, he stuck to this one on the grounds that the video, due to editing including face blurring, zooming and red circles, was not properly verified and could not be played.
The video is expected to be released later after prosecutors said they plan to provide an unedited version.

Hull was the second of four witnesses prosecutors said they planned to call Monday. He is expected to continue testifying Tuesday morning at 9 a.m. MT.

Another video shown Monday includes a car believed to be Robinson’s leaving a home near the UVU campus around midnight on Sept. 11 — about 12 hours after Charlie Kirk was killed on Sept. 10.
As Fox News Digital previously reported, Robinson reportedly met with law enforcement in the area hours after the shooting.
Sometime during the week, the court is expected to hear a previously recorded statement from Robinson’s ex-boyfriend, Lance Twiggs, who prosecutors say obtained a guilty plea after the case.
Robinson has yet to apply. He could face the death penalty if convicted of the highest charge of aggravated murder.
