LARRY KUDLOW: Iran has no War Powers Act

As I am not a lawyer, I do not know whether yesterday’s House resolution ending the war in Iran is constitutional or not. And if it does pass the Senate, President Trump will veto it, and he would be right to do so.

Here’s what I know: it’s stupid. It is also stateless. It also disturbs the commander-in-chief of Mr. Trump is destroying the Islamist regime that has been developing nuclear weapons and sponsoring terrorism for 47 years to bring “death to America.” And “death to Israel.”

Here is what Mr. Trump on Truth Social this morning: “Yesterday, in a meaningless vote, the House voted, 4 bad Republicans and all Dumocrats, to limit my War Powers, during my last negotiations to end the War with the Islamic Republic of Iran. Who would do such an uncivilized thing. They know where the Democratic negotiations will be. Our country has failed rather than giving me one, of many, victories…”

And I, not being a lawyer, if you add up the days of kinetic bombardments, the United States has never hit 60 days, which is in the War Powers Act. The bombing was for 37 days from March 1 to April 7. The ceasefire started on April 8 until today June 4, which is 57 days. So if you look at the numbers, Mr. Trump has 20 days in the bank. He didn’t hit 60, not even close. But who is responsible?

Democrats don’t care about Iran’s nuclear capabilities or its brutal Nazi-like government that directly sponsored the killing of 1,200 Israelis and others, and reportedly more than 40,000 of their Iranian citizens this year alone.

And as the New York Sun points out, using the War Powers Resolution only works in one direction. It doesn’t stop the Iranians from attacking us or attacking Israel or any of our gulf allies in the region. Iran does not have a War Powers Act.

Democrats don’t think Iran is our enemy.

Having said all that, I am sure that Mr. Trump will continue to bury Iran, he will make a good deal. His red lines are stuck and that is very important. I will say this though: many Trumpian supporters, military and non-military alike, myself included, wish we could open the Strait of Hormuz. This will create more public confidence in the war, will lower fuel prices, and will tell Iran that it cannot control this important waterway.

Yesterday evening I spoke with a retired Navy Seal, Mike Sarraille, about the whole issue of opening the Strait and here’s what he said: I explained to him that “a lot of people are waiting to go back to Project Freedom to open the Strait, because we were promised this. We have the military power to do it, but we haven’t followed through. Maybe there are important reasons to help.”

Mr. Sarraille replied: “It would be the most important thing for me,” he added, “But hit the Iranian coast attack force. That’s their drones, their missiles, and the Mosquito, or if you want to call it fast attack ships. Eliminate the problem while those negotiations continue with Iran and keep the blockade in place.”

So the retired Navy SEAL, like many in the military, believes we can do it. And let’s go back to Project Freedom, let’s open it up. And one point I will make again, to repeat this, is not just to lower the prices of electricity and fuel, but to show and tell Iran, you cannot control the Strait, period, full stop.
